Lease Agreement
On this ________________________ 100% MANAGEMENT, INC. (Landlord)
and
__________________________________________________________ (Tenants)
Agree
to lease the premises know as
________________________________________________________, Florida for a
period
of __________________ from ________________________ to _______________________
for private, residential purposes only.
RENT: The total rental to be paid by tenant to the landlord shall be
$____________ payable in monthly installments of $____________,
Rent and each installment shall be paid by check or money order to the landlord
at P.O. BOX 121276, CLERMONT, FLORIDA
34712-1276. Rent is due on the first day of each month. Should it
remain due and unpaid by the fifth (5) of the month a 10% late charge of
$_____________ or $5.00 per day whichever is greater shall be assessed. After
notice to tenant that rent is fifteen (15) days past due and
payable, the landlord shall have the option of declaring the balance of the rent
for the term of this lease to be immediately due and payable.
The landlord may then proceed immediately to collect all of the unpaid rent
called for by this lease, late fees, and any costs and attorney fees
incurred by landlord as a result of tenants failure to pay, by any means
provided by law. There shall be no set-off or deductions from the rent
whatsoever by the tenant.
SECURITY:
Landlord acknowledges receipt from tenant of $______________ which shall be held by
the landlord as security. The security
will not be refunded if tenant fails to occupy the property or violates the
terms and conditions of this lease agreement. The security deposit will
be used to pay for any and all damages to the property and the personal
properties contained therein beyond normal wear and tear. The
property and its equipment will be professionally clean and in good working
order when turned over to tenants. It is the responsibility of
the tenant to document on the move in condition form any and all exceptions and
return the form to landlord within ten days of
move in. The security deposit will also be used to clean the property
including costs of utilities to do so, unless it is returned to the landlord
professionally clean, including but not limited to carpets, appliances,
bathrooms, kitchen, windows, screens, sills, walls, baseboards, and fixtures.
Tenant may not alter the property, paint or install any wiring without the
written consent of landlord. Deposit is held in a non interest bearing
account at Wachovia Bank, Clermont, Florida.
USE
OF PROPERTY: Tenant shall use the property as a private residence only and
may not permit any unlawful act or practice. In the event
that any act or practice by the tenant causes an increase in the insurance rate
to the leased premises, tenant shall immediately be liable to pay said increase
to the landlord. Waterbeds are not allowed without providing landlord a copy of
waterbed insurance for the term of this lease. Tenants will provide landlord
a copy of renters insurance prior to move in.
VISITATION
BY LANDLORD: Landlord (or his agent) has the right to enter and have free
access to the property in order to inspect, protect
during an emergency, make alterations or repairs as necessary, or show to
prospective renters or purchasers.
UTILITIES:
The tenant is to pay for all services and utilities used, consumed or contracted
for except ________________________________
_____________________________________________________. The tenant is to maintain
the yard in a sightly, clean and healthy condition
for the term of this lease. Unless stated otherwise in lease, landlord will bill
tenant if yard work is not done within seven days of written warning. Landlord
is not liable for any charges or damages due to the interruption of services or
utilities beyond the direct control of the landlord. Tenant
agrees to keep power on for 24 hours after lease expires and keys are turned in.
Tenants failure to maintain utilities and services to the property for any
reason is a breach of this lease.
PARKING: At no time will any vehicle be parked on a lawn or will access to property be blocked by tenant or their guests. No unusable vehicles, boats, or recreational vehicles are permitted to remain on property for more than 24 hours without written permission of landlord. Any fines or expenses incurred by landlord as a result of tenant or their guests will be paid by tenant immediately.
LIABILITY:
Landlord is not liable to tenant, or tenants family, guests or employees for
any damage, loss of personal property or injury. Tenant
should have a renters insurance policy for the term of this lease. Under no
circumstances shall landlord be liable for any damages or injury resulting from
any act of negligence or omission by another person or tenant.
TERMINATION:
Tenant must have a written consent of landlord to sublet the property. If tenant
wishes to terminate this lease early, Landlord
may help to re-lease the unit. In either case, there is a service charge to the
tenant of $300.00. Until a new lease is signed all tenants
are jointly
and severally liable under the terms of this lease. Tenant agrees to pay all
costs, expenses and legal fees landlord incurs to enforce the terms of this
lease agreement. Landlord will be entitled to immediately terminate this lease
and take possession of property if tenant defaults and breaches this
lease. The tenant will continue to be liable for rent and all other obligations
under the terms of this lease agreement.
KEYS:
Tenant may never add locks, re-key or change locks without written consent of
landlord and without providing landlord with copies of
all new keys. Once keys are checked out they are the tenants responsibility. All
keys must be returned on the last day of this lease. Tenant will be charged if
landlord must change or re-key lock for any reason.
ADDENDUM'S:
All
parties understand that this lease is a legally binding and enforceable contract
and any modifications, addendum's or
extensions must be in writing. Landlord is acting as agent for the property
owner. There are no oral agreements.
