 Property Management Agreement

__________________ and 100% MANAGEMENT, INC. make and enter into this agreement on this ___________, 20___. Owner employs agent exclusively to rent, lease manage and operate the property known as: ____________________________________________, Florida  under the terms and conditions set forth for a period of ___________________ beginning on __________________, 20___  and ending the ______________, 20___.

This agreement renews and automatically for one year periods unless terminated in writing. Owner may cancel this agreement at any time with at least 60 days written notice. Owner shall pay Agent a fee 80% of management fees which would have been earned through the end of all leases negotiated, prior to any termination or cancellation of this agreement. 

Agent shall have the right to terminate this agreement at any time with 30 days written notice to Owner. After the termination date, no future management fees on negotiated leases shall be due to Agent. 

AGENT AGREES:

  1. To accept the management and furnish the services of 100% MANAGEMENT, Inc. for the renting, leasing, operating and managing of the property under the terms of this contract.

  2. To abide by national, state and local laws pertaining to real estate management and to conduct business with out discrimination or regard to race, creed, age, sex or national origin. 

  3. To send monthly statements of receipts, expenses and charges and to remit the net proceeds over and above a balance of $200.00 to be kept as an operating reserve account. In the event disbursements shall be in excess f the rents collected by the Agent, Owner hereby agrees to pay such excess promptly upon notification by Agent. 

  4. To make the following disbursements on behalf of the owner, when funds are available in owners operating account:

            First mortgage holder_______________________________________

            Yard care________________________________________________

    5.  To assume no liability whatsoever for any of the following:

Acts or omissions of the Owner, any previous Management or agent of either. Previously unknown violations of any environmental or other regulations which may become known during the period this agreement is in effect.

    6.  To bring to the attention of Owner in writing any such regulatory violations or
         hazards discovered by Agent. Owner shall promptly cure any such defects at
         owners expense. 

 

OWNER AGREES:

  1. To give the Agent the following authority and powers and agrees to assume all expenses in connection herewith

To advertise the property, display signs on the property, and lease the property.
To investigate the references of all prospective tenants.
To sign leases for terms of no less than seven months.
To renew or cancel existing leases and negotiate new leases. 
To make the property available for occupancy the ___day of ____________, 20____.

Agent may collect late rent fees, charges for non-negotiable checks or other money instruments, service fees for subleasing or releasing and application fees, without account to the Owner. Such fees belong to the Agent

    2.    To allow Agent to terminate tenancies and sign and serve notices Agent deems
            necessary and Owner approves in order to instigate eviction procedures and to sue for and
            recover rent. Owner will pay all expenses of litigation including attorney's fees and court
            costs which Agent does not recover from tenants. Agent may select the attorney to handle such 
            litigation. 

    3.    To allow Agent to make repairs, provide services, and purchase supplies for the property as
            necessary. The expense of any one item or repair will not exceed $100.00 without the Owner's
            authorization, except if in the opinion of the Agent emergency repairs are needed to protect 
            the property or its occupants and to maintain services to the tenant as called for in their lease
            agreement. 

    4.    To allow the Agent to collect a minimum rent of $__________ and to deposit it in Owners
           account.

    5.     To allow the Agent to collect a minimum security deposit of $_________ and the last month's 
            rent in advance and deposit them in Agents escrow account. Escrow funds accrue no interest 
            for Owner, Agent or Tenant and are not accounted for in Owners monthly statements.

   6.    To hold the Agent free and harmless from all damages sustained by any property or person 
          due to any cause on or about the property. Owner agrees to carry, at his own expense, public 
          liability and other insurance necessary to protect Owner and Agent.

   7.    To defend and reimburse the Agent for expenses of any civil or criminal action, proceeding, 
          charge or prosecution against the Agent or Owner and Agent jointly, due to ay condition or use
   
       of the property or acts or omissions of the Agent or Employees of the Agent, except in cases of 
          Agent's gross negligence.

   8.    To allow Agent to terminate this agreement with 30 days written notice to Owner.

   9.    To pay all costs of enforcement of this agreement, including reasonable attorney's fees, should 
           it become necessary.


COMPENSATION:

Owner shall pay Agent the following fees, plus any sales tax relating to such fees if applicable:

    1.    Owner shall pay or have withheld from collected rents a commission of Ten percent for the 
           term of this agreement and any renewal periods for management services.

    2.    Owner shall pay Agent a commission of Three percent of the sale price in the event this 
           property is sold to any of the tenants during the term of the tenant's occupancy or the next
           six months.

OTHER MUTUAL AGREEMENTS:

 

 

This agreement is binding on the successors and assigns of the Agent as well as the owner's 
heirs, administrators, executors, successors and assigns. This agreement contains all the 
terms and conditions of the business relationship between parties.
